Commercial-In-Confidence and Privacy Policy

The primary function of this tool is to capture information to help in the development of a workforce development strategy that leads to increased productivity for your organisation.  It becomes the baseline data used to create reports for use by your organisation.  Data collected by SkillGAP will be treated commercial-in-confidence and will not be shared with a third party without your consent.   Essentially ‘commercial-in-confidence’ means ‘confidential information’.

Data is also collected to provide broad advice to the government and industry. This data is combined and general statistics are generated. Individual company information is not provided, nor can it be inferred from this statistics. 

Management of personal information  

All personal information collected through SkillGAP is protected by the Privacy Act 1988. Information on the Commonwealth Privacy Act 1988 can be found on the Federal Privacy Commissioner's web site.

In summary, 'personal information' is information or an opinion relating to an individual which can be used to identify that individual.

The Privacy Act 1988 requires the Industry Skills Councils’ to take reasonable steps to protect the security of personal information. Personnel are required to respect the confidentiality of personal information and the privacy of individuals. Each Industry Skills Council takes reasonable steps to protect personal information held from misuse and loss and from unauthorised access, modification or disclosure, for example by use of physical security and restricted access to electronic records. Where we no longer require your personal information for a permitted purpose under The Privacy Act 1988, reasonable steps will be taken to destroy it.

Security of Information 

The SkillGAP diagnostic tool, internal network and databases are protected from unauthorised access using current technologies. For optimal security, the tool uses Secure Sockets Layer (SSL) technology, protecting the Web site and its visitors by encrypting sensitive information and providing authenticated information about the certificate owner. A privacy statement has also been developed and openly displayed within the tool providing users with a clear explanation of the intended use of the information, detailing confidentiality disclosures and offering advice and guidance around the implications of disclosing information. 

You should be aware that there are inherent risks associated with the transmission of information via the Internet. You may wish to contact the representative allocated to your survey if you do not want to transmit specific information across the Internet and arrange for alternative methods of transporting the information. 

Access to your personal information  

Subject to the exceptions set out in the Privacy Act, you may gain access to the personal information which the Industry Skills Council hold about you by contacting the representative allocated to your survey.  

They will require you to verify your identity and to specify what information you require. A fee may be charged for providing access. We will advise you of the likely cost in advance.
